This privacy policy applies to the AvianAI app (hereinafter referred to as "Application") for mobile devices that was created by freeweb (hereinafter referred to as "Service Provider") as a free service. This service is intended for use "AS IS".

These photos are sent to an external AI service for species identification and are not uploaded to any cloud storage for persistent storage. Identified results and photo files are stored locally on your device.

The Application utilizes third-party services that automatically collect user information for advertising delivery and usage analytics purposes. Below are the details of the third-party services used by the Application:

Google Analytics 4 (Firebase Analytics) and Google AdMob

The Application uses Google Analytics 4 and AdMob for usage analytics and ad delivery, and may automatically collect user information. These services may use cookies or advertising identifiers to track user activity. Collected data may include device information, usage patterns, and advertising identifiers for ad personalization.

OpenAI API

When you use the bird identification feature, your photos are sent to the Service Provider's proxy server which forwards them to OpenAI's API for species identification. The data sent includes base64-encoded images and date metadata. The Service Provider's server manages the API key and does not transmit it to the client device. 3. Opt-Out Rights

You can stop all collection of information by the Application easily by uninstalling it. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.

For Google Analytics and AdMob, you can manage your ad personalization preferences through your device settings or through Google Ads Settings.

4. Data Retention Policy

The Service Provider will retain User Provided data for as long as you use the Application and for a reasonable time thereafter. Locally stored data (observation records, life list, photos, settings) remains on your device until you delete it through the Application's settings or uninstall the Application.

Data sent to third-party services (Google, OpenAI) is subject to their respective data retention policies. Analytics data collected by Google Analytics is retained in accordance with Google's data retention practices.

If you'd like the Service Provider to delete User Provided Data that you have provided via the Application, please contact them at eerf0309+AvianAI@gmail.com and they will respond in a reasonable time.

5. Children

The Service Provider does not use the Application to knowingly solicit data from or market to children under the age of 13.

The Application does not address anyone under the age of 13. The Service Provider does not knowingly collect personally identifiable information from children under 13 years of age. In the case the Service Provider discovers that a child under 13 has provided personal information, the Service Provider will immediately delete this from their servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact the Service Provider (eerf0309+AvianAI@gmail.com) so that they will be able to take the necessary actions.

The Service Provider is concerned about safeguarding the confidentiality of your information. The Service Provider provides physical, electronic, and procedural safeguards to protect information the Service Provider processes and maintains. All communications with external services use encrypted HTTPS connections.

7. Changes

This Privacy Policy may be updated from time to time for any reason. The Service Provider will notify you of any changes to the Privacy Policy by updating this page with the new Privacy Policy. You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.
